General Terms & Conditions of Sales

The company YOGA SPIRIT LTD operates the brand and trade name SOHO CONCEPT, under which the physical store and website are operated.
Hereinafter referred to as "the Company".

2. Purpose

These general terms and conditions of sale (GTC) govern the relationship between the Company and any individual making a purchase via the website www.sohoconcept.mu, hereinafter referred to as "the Customer".
They define the terms of distance selling: ordering, payment, delivery, returns and customer service.
Any order placed on the site implies full and complete acceptance of these Terms and Conditions.
The Company reserves the right to modify these terms and conditions at any time. The applicable terms and conditions are those in effect at the time of the order.

3. Products

The products offered for sale are those presented on the website www.sohoconcept.mu .
They are offered while stocks last.
The Company strives to present its products as accurately as possible. However, the photographs and descriptions on the website are not contractual and may differ slightly from the delivered product.

4. Price

Prices are quoted in Mauritian rupees (MUR), inclusive of all taxes (TTC).
Delivery charges are the responsibility of the Customer unless otherwise stated. The Company reserves the right to change its prices at any time. Products will be invoiced based on the rates in effect at the time the order is validated.

5. Order

To place an order, the Customer must select the desired products and validate their basket.
Once the order is confirmed and the payment is validated, a confirmation email will be sent to the Customer.
The Company reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, non-payment or suspicion of fraud.

6. Payment

Payment can be made via bank card (Visa or Mastercard), PayPal or Juice by MCB.
Transactions are secured via the MIPS payment platform incorporating the 3D Secure standard.
The invoice can be sent by email or included in the package.
In the event that a product is unavailable after an order has been placed, the Company may offer an equivalent product, a credit note or a refund.

7. Delivery

Orders can be shipped to Mauritius, Rodrigues, Madagascar, Comoros, Mayotte, Seychelles, Sri Lanka, Kenya, Tanzania, Mozambique, Zimbabwe, Zambia, Botswana, Namibia, South Africa, Lesotho and Malawi.
The indicative delivery times are 15 working days for standard delivery and 5 to 6 working days for express delivery.
These delivery times are indicative and may vary depending on the carrier. The Company cannot be held responsible for delays related to carriers, customs procedures, or force majeure.
The Customer must check the condition of the package and the conformity of the products upon receipt.

8. In-store pickup (Click and Collect)

If the option is offered, the Customer can choose to collect their order directly in store.
When the order is ready, the Customer is notified by email or message.
The order must be collected within 14 days. After this period, the order may be cancelled and converted into a credit note.

9. Physical store

The Company operates two boutiques under the SOHO CONCEPT brand located in Domaine de Labourdonnais, Quartier des Serres, Mapou, Mauritius and in Ruisseau Créole
The products offered on the website may also be available in store, subject to availability.
The conditions applicable to purchases made in store may differ from those applicable to purchases made on the website.

10. Returns and exchanges

The Customer has 14 days from receipt of the order to make a return request.
Returned products must be unworn, unused and in their original packaging.
Return shipping costs are the responsibility of the customer.
Returns may result in an exchange, a credit note or a refund depending on the case.

11. Gift cards and promotions

The Company may offer gift cards, promotional codes or commercial offers.
Gift cards are valid for 12 months from the date of purchase.
They cannot be refunded or exchanged for money.
Promotions cannot be combined unless otherwise stated.

12. Data Protection

The information collected on the site is used solely to process orders, maintain customer relations, and improve the services offered.
The Client has the right to access, modify and delete their personal data.

13. Intellectual Property

All elements of the website www.sohoconcept.mu (texts, images, logos, visuals, design) are the exclusive property of YOGA SPIRIT LTD.
Any reproduction, modification or use without prior authorization is strictly prohibited.

14. Responsibility

The Company cannot be held liable for damages resulting from the use of the Internet network, including but not limited to data loss, intrusion, viruses or service interruption.

15. Force majeure

The Company shall not be held liable for the non-performance of its obligations in the event of force majeure, including natural disasters, strikes, logistical disruptions or transport problems.

16. Applicable Law

These general terms and conditions of sale are governed by Mauritian law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
The Mauritian courts will have sole jurisdiction.

17. Package marked as delivered

When a package is marked as delivered by the carrier, the order is considered to have been received by the Customer.
In the event of a delivery problem, the Customer must contact the Company so that a claim can be opened with the carrier.
The Company cannot be held responsible in case of loss or theft of the package after confirmation of delivery by the carrier.

18. Pricing or display error

The Company strives to ensure the accuracy of the information and prices displayed on the website. However, in the event of a clear pricing or display error, the Company reserves the right to cancel the order and inform the Customer. The Customer may then choose between a refund or confirmation of the order at the correct price.

19. International Taxes and Customs

For deliveries made outside of Mauritius, customs duties, local taxes or import fees may be required by the authorities of the destination country.
These costs are the responsibility of the Client.
The Company cannot be held responsible for these additional costs or for delays related to customs procedures.
